A bereavement can be a very traumatic and stressful experience especially if you are responsible for administering the Estate of the deceased person. With our knowledge and experience we can guide you through this very difficult time.

If you act as an Executor/Administrator you will be accepting a high degree of responsibility. You will be having to collect in the assets, pay the debts and distribute the Estate in accordance with the Will or the Rules of Intestacy.

You may not be aware of all the debts of the Estate. Some may come to light at a later date, and in case of intestacy you may not be aware of all the potential beneficiaries. You may be personally liable if you do not distribute the Estate correctly.

Depending on the value of the Estate you will usually need to apply to the Court for a Grant of Probate. This involves completing either the shorter Inland Revenue Account or the full and quite complex Inland Revenue Inheritance Tax Return. You may need to account to the Inland Revenue for gifts made during the deceased's life - some may be taxable or may be exempt.

You may also need to claim Business Property Relief or Agricultural Property Relief, Charitable or Spouse exemption. Overlooking assets may lead to penalties. However failure to claim exemptions or reliefs may lead to the Estate paying more tax than necessary.

You can appoint us to act for you and give us the responsibility of making sure the Estate is administered correctly. We can prepare the papers to lead to a Grant of Probate or Grant of Letters of Administration including the Inheritance Tax Account and make the application to the Court on your behalf. We can advise you on how to protect yourself in the case of possible creditors or missing beneficiaries. We can advise you on post death tax planning and Deeds of Variation, Estates involving business assets and foreign property, intestacies and potential disputes and inheritance act claims.

We do not charge a percentage element and in many cases offer fixed fees if the estate is below £325,000.
