Since October 2007 there are now two types of Lasting Powers of Attorney you can have - One for Property and Financial Affairs and one for Personal Welfare We recommend all our Clients execute Lasting Powers of Attorney no matter their age.


Lasting Power of Attorney for Property and Financial Affairs

People can lose mental capacity through illness or accident as well as old age. If this was to happen to you and you did not have a Lasting Power of Attorney for Property and Financial Affairs, you would not be able to deal with your money or property and no one would be able to do so on your behalf. It would be too late to execute a Lasting Power of Attorney because you must have sufficient capacity at the time of signing it. The only option of would be for someone, often a member of your family, to apply to the Court of Protection for a Deputyship Order to enable them to deal with your property and money on your behalf. This is a very lengthy process and far more expensive than making a Lasting Power of Attorney.


Lasting Powers of Attorney for Health and Welfare


This enables you to appoint Attorneys to make decisions about your health and welfare if at any future date you lack the capacity to make those decisions yourself. The decisions can include decisions about your healthcare, medical treatment and where you live. They can be extended if you wish to give consent to life sustaining treatment. Without a Lasting Power of Attorney for Health and Welfare no one has authority to make these types of decisions if you are unable to make them yourself. It is possible however, for health and social care professionals to make decisions if they think you lack capacity and they believe it is your best interests. They do not have to follow what the family want and are not liable for the decisions they make on your behalf. Lasting Powers of Attorney are lengthy to complete and if they are completed incorrectly they will be refused registration and be unusable. They are very powerful documents and it is important to obtain advice about the choices you have.
